California Puppy Purchase Agreement, Bill of Sale & Health Guarantee
This Puppy Purchase Agreement and Health Guarantee (“Agreement”) is entered into between Debbie's Darling Shih Tzus (“Breeder”) and the purchaser identified below (“Buyer”).
This Agreement documents the sale of the puppy described below and the responsibilities of both Breeder and Buyer.
Nothing in this Agreement is intended to waive, restrict, or eliminate any right or remedy that cannot legally be waived under California law.

All payments, deposits, refunds, and reservation payments shall be handled in accordance with applicable California law.
Nothing in this Agreement makes a payment nonrefundable where California law requires the payment to be refundable.

4. PET-ONLY SALE — NO BREEDING RIGHTS
This puppy is being sold strictly as a companion pet.
The puppy is not being sold for breeding purposes, and Buyer agrees not to intentionally breed this puppy.
No breeding rights are included in the purchase price unless Breeder specifically agrees otherwise in a separate written agreement signed by both parties.
The puppy's parents may be registered with the American Kennel Club (AKC). However, the puppy is sold without AKC registration papers or breeding rights unless specifically stated otherwise in writing by Breeder.

5. VETERINARY HEALTH EXAMINATION BEFORE SALE
Before leaving Debbie's Darling Shih Tzus, the puppy will be examined by Breeder's licensed veterinarian.
Buyer will receive a copy of the puppy's veterinary health certificate showing the results/date of that examination.
Breeder will also provide available vaccination and medical records pertaining to the puppy.
To the best of Breeder's knowledge at the time of sale, except for any condition specifically disclosed in writing, the puppy has no known illness, disease, congenital condition, or hereditary condition adversely affecting its health.

6. BUYER'S REQUIRED 3-DAY VETERINARY EXAMINATION
As a condition of Debbie's Darling Shih Tzus' additional contractual health guarantee, Buyer must have the puppy examined by a licensed veterinarian of Buyer's choice within three (3) calendar days of the date shown on the veterinary health certificate provided by Breeder.
The three-day period begins from the date of Breeder's veterinary health certificate, not from the date Buyer chooses to schedule the examination.
Buyer is responsible for scheduling and paying for this examination.
Buyer should provide the veterinarian with the puppy's health certificate and medical/vaccination records.
If Buyer does not have the puppy examined by a licensed veterinarian within this three-day period, Debbie's Darling Shih Tzus' additional contractual health guarantee will not take effect.
This three-day requirement applies only to Breeder's additional contractual health guarantee.
It does not waive, shorten, restrict, or eliminate any rights or remedies Buyer may independently have under applicable California law.

7. ONE-YEAR BREEDER HEALTH GUARANTEE
Provided Buyer complies with the three-day veterinary examination requirement above, Debbie's Darling Shih Tzus provides an additional one-year health guarantee beginning on the date Buyer takes physical possession of the puppy.
This guarantee applies to a serious congenital or hereditary condition that materially and adversely affects the puppy's health.
Any claim must be supported by a written diagnosis from a licensed veterinarian identifying the condition.
Buyer must notify Breeder promptly after receiving the diagnosis and provide Breeder with copies of the veterinarian's written diagnosis and related medical records.
Where permitted by law, Breeder reserves the right to obtain a second veterinary opinion regarding the diagnosis.
If a second opinion is requested by Breeder, Breeder will pay the cost of that examination when required by applicable law.
This contractual health guarantee is provided in addition to, and does not replace or reduce, any greater protection Buyer may have under California law.

8. CALIFORNIA STATUTORY HEALTH RIGHTS
California law may provide purchasers with additional remedies if a puppy is determined by a California-licensed veterinarian to have certain illnesses, diseases, congenital conditions, or hereditary conditions.
Where applicable, California law provides protections for certain qualifying illnesses or diseases existing on or before delivery that are identified within 15 days after the purchaser takes physical possession of the puppy.
California law may also provide protections for certain qualifying congenital or hereditary conditions identified within one year after the purchaser takes physical possession of the puppy.
The applicable California statutes determine the purchaser's eligibility, documentation requirements, remedies, and deadlines.
Nothing in this Agreement waives or reduces any nonwaivable right or remedy provided by California law.
Buyer will receive any separate California Notice of Rights required by applicable law.

9. VACCINATIONS AND MEDICAL RECORDS
Buyer will receive available records documenting the puppy's vaccinations and veterinary care before transfer.
Buyer understands that the puppy will require continued veterinary care throughout its life.
Buyer is responsible for following the recommendations of Buyer's veterinarian regarding vaccinations, preventative care, examinations, and other medical treatment after taking possession.

10. CONDITIONS NOT COVERED BY BREEDER'S ADDITIONAL GUARANTEE
Except where applicable California law provides otherwise, Breeder's additional contractual health guarantee does not cover conditions caused after the puppy leaves Breeder's care, including:
- Accidents or injuries;
- Abuse or neglect;
- Improper care;
- Failure to obtain appropriate veterinary treatment;
- Poisoning;
- Ingestion of foreign objects;
- Improper nutrition;
- Exposure to hazards after delivery;
- Illness or disease contracted after delivery;
- Conditions resulting from circumstances occurring after the puppy leaves Breeder's care.
Routine veterinary expenses and ordinary expenses associated with owning and caring for a puppy are Buyer's responsibility unless reimbursement is required by applicable law.

11. ADULT SIZE, WEIGHT, COLOR AND APPEARANCE
Any statement by Breeder regarding the puppy's expected adult weight, size, coat, color, markings, temperament, or appearance is an estimate only.
Breeder cannot guarantee the puppy's exact adult weight, size, coat texture, color, markings, temperament, or appearance.
Puppies develop differently, and these characteristics may change as the puppy matures.

12. BUYER'S RESPONSIBILITY FOR CARE
Buyer agrees to provide the puppy with appropriate lifelong care, including:
- Nutritious food appropriate for the puppy's age and size;
- Fresh water;
- Regular veterinary care;
- Appropriate vaccinations and preventative care;
- Proper grooming;
- Safe and sanitary living conditions;
- Appropriate exercise;
- Socialization;
- Love, attention, and companionship;
- Protection from abuse, neglect, unsafe environments, and extreme temperatures.
Buyer agrees to comply with applicable state and local animal-care and licensing laws.

13. REHOMING
If Buyer is ever unable to properly care for or keep the puppy/dog, Buyer agrees to contact Debbie's Darling Shih Tzus before surrendering the dog to an animal shelter or rescue organization.
Breeder may assist Buyer in finding an appropriate new home or may agree to accept the dog back.
Unless otherwise required by law or specifically agreed to in writing, returning the dog to Breeder under this provision does not automatically entitle Buyer to a refund.
The health, safety, and welfare of the dog shall be the primary consideration.

14. NO COMMERCIAL RESALE
Buyer agrees not to knowingly sell, transfer, or surrender the puppy to a:
- Puppy mill;
- Commercial breeding operation;
- Pet broker;
- Laboratory;
- Commercial animal reseller; or
- Similar operation.

15. DELIVERY OR TRANSPORTATION
If transportation or delivery of the puppy is arranged, Buyer and Breeder will agree upon the method, location, cost, and responsible party.
Transportation arrangements do not alter the health protections or other rights that cannot legally be waived under California law.

16. ENTIRE AGREEMENT
This Agreement represents the parties' agreement concerning the purchase of this puppy together with any disclosures, veterinary records, certificates, and notices required by law.
Any modification to this Agreement should be made in writing and signed by both Buyer and Breeder.
If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain effective to the fullest extent permitted by law.
This Agreement shall be interpreted according to the laws of the State of California.
Nothing contained in this Agreement is intended to waive any legal right that California law does not permit the parties to waive.

17. BUYER ACKNOWLEDGMENT
By signing below, Buyer acknowledges that Buyer:
- Has read and understands this Agreement;
- Has had an opportunity to ask questions;
- Has received or will receive the puppy's veterinary health certificate;
- Has received or will receive available vaccination and medical records;
- Understands the three-day veterinary examination requirement for Breeder's additional contractual health guarantee;
- Understands that the three-day period runs from the date on Breeder's veterinary health certificate;
- Understands that failure to obtain the required examination within that period means Breeder's additional contractual health guarantee will not take effect;
- Understands that this requirement does not eliminate any nonwaivable rights Buyer may have under California law;
- Has been informed of any known health conditions disclosed by Breeder;
- Has received or will receive any separate notices required by California law.
Buyer understands that purchasing a puppy is a long-term commitment involving veterinary care, food, grooming, training, companionship, and other expenses.
